Investigating protective and educational measures in the field of financial and economic crimes in Iran, France and Islamic jurisprudence

Abstract

Provisional and educational measures are a series of social defense means that are applied according to the law and by the judge and due to the occurrence of a crime, according to the situation of the guilty person, until the person recovers and adapts to the society and does not commit a crime. These measures have the power of obligation and coercion and are implemented in the case of dangerous people in order to prevent the possible commission of crimes in order to maintain the general order of the society. The purpose of the current research is to investigate and compare the protective and educational measures in Iranian and French law, which is a descriptive-analytical method. The results indicate that the principles of protective and educational measures in Iranian law are relatively compatible with French law. Provisional and educational measures are considered a basic requirement in Iranian and French law along with other punishments. The adoption of protective and educational measures has been established in the laws of Iran and France
